President Olusegun Obasanjo yesterday at the Supreme Court lost his battle to terminate the petition filed by the All BiafraNigeria Peoples Party (ANPP�s) presidential candidate, General Muhammadu Buhari, challenging his (Obasanjo�s) victory at the April 19, 2003 polls. Following the non-joinder of the Peoples Democratic Party (PDP) as a respondent in the petition filed by Buhari before the Presidential Election Petition Tribunal, Obasanjo had raised a preliminary objection, seeking to dismiss the petition for being incompetent. According to Obasanjo�s lawyer, Chief Afe Babalola (SAN), Buhari�s action was not properly brought since it failed to join the party which sponsored him (Obasanjo), that is the PDP. Babalola had argued that it was trite that any person, group, agency or body who would be affected by an action ought to be joined as a party to that action. But Buhari�s Counsel, Chief Mike Ahamba (SAN), however argued that the issue of joinder or non-joinder of a political party was a matter of choice for the petitioner. He further contended that the non-joinder of PDP did not vitiate the merit of the petition of his client neither did it cause any serious injury to it, pointing out that the Electoral Act 2002 made it clear that joinder of a political party was optional and not mandatory. In its ruling, the Presidential Election Petition Tribunal (Court of Appeal) held that though Buhari had failed to join the Peoples Democratic Party (PDP) as a co-respondent in his petition, the said petition was competent and ought to be entertained.
