Legal moves by President Olusegun Obasanjo to halt proceedings at the election tribunal hearing the petition filed against him by defeated All Nigeria Peoples Party (ANNP) presidential candidate, Gen. Muhammadu Buhari (rtd), have suffered a set-back. The Supreme Court panel, headed by Chief Justice of the Federation, Muhammadu Lawal Uwais, yesterday dismissed Obasanjo's application for stay of proceeding at the election tribunal. Obasanjo, through his lawyers led by Chief Afe Babalola (SAN), had applied to the apex court praying for an order of stay of proceedings at the Justice Umaru Abdullahi-led presidential election petition tribunal pending the determination of a subsisting appeal he filed challenging the July 28 decision of the election panel not to quash Gen. Muhammadu Buhari's petition. The other application rejected yesterday by the apex court after a marathon session was a leave of the Supreme Court to enable Obasanjo file his appeal at the Supreme Court challenging the election tribunal verdict. On July 28, 2003, the election tribunal dismissed a preliminary objection by Obasanjo and the Independent National Electoral Commission (INEC) to the petition by Buhari, the presidential candidate of the All Nigeria People (Guardian) |
