Airways workers ask IG to halt forceful take-over of airline

LAGOS — NIGERIA Airways’ workers have called on the Inspector General of Police, Mr. Tafa Balogun, to stop the liquidator of the airline, Babington Ashaye and Company Limited from using men of the Police Force to take over the airline’s premises.
The liquidator had tried to take over the airline’s premises in the last two weeks, but met with resistance from the workers.
A judgement in suit FHC/ABJ/PET/2/2004, delivered on July 9, 2004, by the Federal High Court, Abuja, had appointed Babington Ashaye as the liquidator of Nigeria Airways, empowering it to take over the assets by securing the premises.

But the workers had since filed an Appeal at the  Appeal Court in Abuja challenging the judgement of the lower court.
Writing the Inspector General of Police through their solicitors, Soji Adebola Chambers, the workers said the liquidator’s efforts at taking over the airline’s premises would amount to contempt of court, since there is an existing and subsisting order of injunction against the compulsory liquidation of the airline.

The solicitor stated: “ There is an existing and subsisting order of injunction that the company cannot continue or proceed with the winding up of the company until the substantive suit FHC/ABJ/PET/6/2002 has been determined.  The said suit is still pending before Justice Adah of the Federal High Court in Abuja.

“Our clients fear that the liquidator, Mr. Babington Ashaye may try to enlist the assistance and support of the police to physically take over the premises of the company to change the status quo to his favour before the hearing of the application pending in court without giving the police the background information.”
