ABUJA—THE Peoples Democratic Party has filed an action before a Federal high court sitting in Abuja seeking to stop the Federal Government from further releasing local government allocation to the state government.
The party cited flagrant violations of the provisions of the 1999 constitution and the Electoral Act 2002 by the state as reasons for its prayers.
Specifically, PDP is accusing the government of Jigawa state of putting in place a caretaker system of local government administration instead of a democratically elected council regime.
PDP also said that the All Nigerian Peoples Party led-government in Jigawa State had created additional wards in total disregard of the constitution.
The party also asked the court to void the Jigawa State Local Government (Amendment) Law 2004 because some sections of the law are contrary to the provisions of the 1999 constitution.
PDP contended that rather than conducting elections into the 27 existing councils in the state, the state government chose to create consultative assemblies purportedly acting under the Jigawa State Local Government (Amendment) Law 2004.
An affidavit accompanying the originating summons said the PDP is not happy with the steps taken by the state government to prevent democratic elections.
It further stated that the election proposed by the state government under its new law would not be free and fair.
The affidavit reads: “If the defendants (including Ministry of Finance, Revenue Mobilisation, Allocation and Fiscal Commission) are not restrained from releasing disbursement meant for Jigawa State, same would be released to the Governor of Jigawa State, Saminu Turaki who would pay same into joint account (not between state and local governments) but between state and various tiers of consultative assemblies created out of the 27 recognized local government councils.
No date has been fixed for hearing of the case.
