$242M Scam: Court Hears Nwude's Bail Application

An Ikeja High Court Judge, Justice Olubunmi Oye-wole, has adjourned till today hearing in the bail application filed by Chief Emmanuel Nwude, 1st accused person in an on-going trial involving three accused persons for their alleged involvement in a $242 million Advance Fee Fraud a.k.a. 419 scam.
Nwude, alongside Mrs. Amaka Anajemba and Mr. Nzeribe Edeh Okoli, were re-arraigned in Lagos on July 23 by Economic and Financial Crimes Commission (EFCC) to face a new 98-count charge. An Abuja High Court recently dismissed the 86-count charge brought against the accused persons, allegedly for lack of territorial jurisdiction. Alleged offences were committed between April 2, 1995 to January 20, 1998 at Opebi, Ikeja, within Lagos jurisdiction.
However, sources have revealed that present condition of Nwude, whose absence in court on July 30 (second hearing) due to alleged ill-health, which had stalled trial then, has worsened, a fact that led to his counsel, Mr. Alex Izinyon (SAN) filing an application, urging court to grant his client bail to enable him receive adequate medical treatment for his undisclosed ailment.
Justice Oyewole had earlier adjourned further hearing of the bail applications till today and October 4, 5 and 6 for trial dates. He had ordered the accused persons to be remanded at the Ikoyi Prisons till the next adjourned date.
Izinyon had earlier tendered a letter purportedly written by the Prisons Service on the 1st accused's state of health, following his absence from court at the last adjourned date, which had stalled the trial. However, prosecution counsel Mr. Rotimi Jacobs, had opposed the bail application, claiming the letter by the Prisons authorities on the health of the 1st accused person had not shown any medical record indicating his health status.
"We were not informed about the ill-health otherwise we would have taken him to the National Hospital," he said. However, Justice Oyewole, ruling on the submissions, had requested a second medical opinion to ensure the actual health situation of Nwude and adjourned hearing of his bail application till today. `
