Loan: Gani to Sue FG

Lagos-based lawyer, Chief Gani Fawehinmi (SAN), has decided to sue Federal Government over its decision to grant loan to Ghana and Sao Tome without resorting to the National Assembly.
He gave the hint weekend in Akure while fielding questions from newsmen during the dinner organised by the Nigerian Bar Association (NBA), Akure branch.
But, Prince Kayode Adetokunbo (SAN), has said the decision was taken in the interest of the nation as Nigeria stands to gain from the whole exercise.
Fawehinmi described it as "a gross abuse of the constitutional process and a serious misconduct on the part of the president."
He noted that to check the excesses of the President Olusegun Obasanjo he is going to court, saying "this cannot continue."
The President, according to him, acted against the provision of section 164(2) of the 1999 Constitution which states that the permission of the National Assembly must be obtained before financial grant could be made to foreign bodies or countries.
"The President has actually taken the National Assembly for a ride and the legislators should view it as a serious misconduct. His action is clearly contrary to section 164(2) of the Constitution."
He continued "that section states that grants to foreign governments and international institutions can only be made in accordance with the laid down conditions of the National Assembly which must be adhered to before any grant is made."
"Obasanjo's path as the President of this country is littered with illegalities, unconstitutionalities, arrogance and obstinacy in the way he governs this country. He is not governing this country according to the law or constitutional order but according to his whims and caprices. This posture is capable of stalling our democratic process and as a matter of fact derailing it," he said.
