LAGOS—EFFORTS by the three Advance Fee Fraud suspects, Mr. Emmanuel Nwude, Mrs Amaka Anajemba and Chief Nzeribe Okoli to regain their freedom suffered a set back yesterday as a Lagos High Court, Ikeja dismissed their bail applications on the ground of the gravity of offences allegedly committed by them.
Justice Joseph Olubunmi Oyewole, in his 45 minutes ruling said that the court turned down the applicants’ prayers for bail due to “the affidavit evidence” which supercede the plea for bail rendered by the accused persons.
The trio of Nwude, Anajemba and Okoli were standing 95 counts criminal trial of fraudulently enriching themselves to the tune of $242 million by swindling a Brazilian bank in 1995.
The accused persons before yesterday’s ruling have canvassed for bail through their counsels, which included eminent jurist, Chief Rotimi Williams (SAN), and four other Senior Advocates before the Ikeja High Court on ill-health and compassionate grounds.
Delivering his ruling yesterday Justice Oyewole held that “considering the nature and gravity Of the offence” against the accused persons the court cannot exercise its discretion in favour of the accused persons.
Justice Oyewole said: “95 counts were preferred against the applicants, count 1 is alleged conspiracy to obtain money by false pretence, while counts 2-14 are alleged offences of obtaining by false pretence, count 15 is alleged conspiracy to launder money, while 16-42 and 86-95 are for alleged money laundering, counts 43 and 44 are alleged conspiracy under Criminal Code while counts 45-80 and 85 are alleged offences of forgery and uttering of false documents under section 467 (2) and 468 of the Criminal Code, and counts 81-84 are alleged offences of forgery and uttering of seals of the presidency.”
