Budget: 3-Year Expenditure Framework Unconstitutional-Group

Three-year medium term expenditure framework, which the Federal Government plans to adopt from the next fiscal year, has been described as an executive policy that has no constitutional backing.

Minister of Finance, Dr (Mrs) Ngozi Okonjo-Iweala, had two weeks ago, hinted about Government's plan to adopt a three-year budgetary system from 2005 as part of the strategy to control expenditure by the Government in the face of rising oil prices and thus stabilize the economy.

In a presentation to the Training/Stakeholders Meeting on Budgetary Advocacy and Monitoring organised by Concerned Professionals, a non-governmental organisation (NGO) yesterday, a Legal Consultant, Mr. Kalu Onuoha, said the new policy had no legal backing saying it was a mere proclamation by the executive.

"I think the statement credited to Minister of Finance is just a policy statement that has no legal backing" Onuoha in response to a question.

He said Section 81 of the Constitution was very clear about the nature of the country's budget adding, "there is no room for two or three years expenditure framework."

The stakeholders' meeting was organized with support from the UK Department For International Development (DFID) under the Nigeria Governance Fund (NGF) managed by the British Council. It drew participants from representatives of NGOs and civil society organsisations.

In a paper, titled 'Legal Regulation of Budgeting' Onuoha faulted the constitutional provision on the budget process saying they were not adequate for a virile budgeting system that would meet the yearnings and aspirations of Nigerians.
