commends new Lagos civil procedure rules

The new civil procedure rules introduced
by Lagos State in its judicial system has been recommended for other states as
it will ensure prompt dispensation of justice.
Speaking at the launching of “The
Blue Book 2004, practical approach to the High Court of Lagos State (civil
procedure) rules 2004” on Tuesday, a judge of the Supreme Court, Hon.
Justice Salihu Modibo Alfa Belgore noted that with the new rules, extensive
delays in the state’s legal system will be effectively curbed.
To the judge, long delays in the
administration of justice in the country could be attributed to the rules
inherited from the British system, and Nigerians penchant for resolving
disputes through the court.
According to Alfa Belgore, judges should
not be blame for the long delays in the court process.
He recalled that the 1994 rules, which
the new procedures replaced were inherited from the British with some
modifications, even as he said that the rules did not reflect the Nigerian
tradition of faith in God as the ultimate judge.
The Supreme Court judge took a swipe at
the principle of proof “beyond reasonable doubt” which he regretted
has allowed many criminals with very grievous offences to delay the process of
justice and waste the time of courts.
He said that the new civil procedure
rules of the state is a great departure from the norm, especially with the
introduction of the option of settlement.
The state governor, Bola Ahmed Tinubu who
also spoke at the occasion said that the many innovations introduced by the
state in the judiciary were meant to ensure quick dispensation of justice.
The governor said that a new court
complex has just been completed and would soon be completed, adding that his
government will continue to chart the course of innovation in governance.
The book authored by Muiz Banire and
associates was reviewed by Prof. Taiwo Osipitan who in his review expressed the
need for the chief judge to be proactive in handling the rules so that the
whims and caprices ? ? do not hold sway.
