M.T. African Pride: FG Loses Bid to Halt Trial of 13 Russians

As the mystery surrounding the sudden disappearance of the seized vessel, M.T. African Pride, persists, a Federal High Court in Lagos has refused an application brought before it by the Federal Government seeking to stay further proceedings in the trial of 13 Russians for allegedly using the vessel for illegal oil bunkering. Trial judge, Justice Gloria Okeke, in a ruling yesterday stated that the continued hearing of the case will not be an injustice because it is a criminal one; adding that the justice of the case will be better served if the refused. The government had earlier sought to amend the two-count charge preferred against the accused persons, but the court refused the application on ground among others; that the development will amount to starting the trial which was nearing its end afresh. The judge had reasoned that the accused who were refused bail had been in detention since march 2 and that the case being a criminal one ought to have been given a speedy trial. But dissatisfied with the ruling, the government through its counsel, Mrs Pat Ajoku, headed for the Appeal Court and thereafter brought the application for stay of the proceedings pending the hearing and determination of the appeal. Ajoku in her argument had contended that it would be in the interest of justice to put the trial on hold pending the determination of the appeal. But Emefo Etudo, representing the accused foreigners had argued that it would not be in the interest of justice as the accused had been in prison custody for almost one year. He had also complained that the accused were being maltreated in the custody.
