Appeal Court Insists NLC Can't Go on Strike

The Court of Appeal, Abuja yesterday restated its earlier order restraining the Nigerian Labour Congress (NLC) and its President, Comrade Adams Oshiomhole, from calling out workers or embarking on any strike action over the last increase in the pump prices of petroleum products. The order will subsist pending the determination of an appeal challenging the judgment of a Federal High Court, Abuja delivered by Justice Roseline Ukeje, Chief Judge of the Federal High Court. Ukeje in the earlier judgment held that the office of NLC President was not recognised by law. She also ruled against labour protesting economic policies of government. Justice Ibrahim Tanko Muhammad in his lead judgment supported by Justices Zainab Adamu Bulkachuwa and Mary Peter Odili discharged the interim order he made on November 11, 2004 in respect of the same matter and made a similar order restraining NLC by themselves, agents, privies or otherwise so called from embarking on strike pending the determination of the appeal before the court. The court, however, turned down government's request for "an order of injunction restraining the 2nd Appellant/Respondent (Oshiomhole) his officers, privies, associates, servants, agents and any other person howsoever described from summoning any meeting, holding any rally and or convocating any gathering or implementing or planning or preparing for any strike action in respect of the subject matter of this appeal pending the hearing and determination of the appellants' appeal." Rather, the court held that the relief if granted would cripple some of NLC's activities, which may not relate to strikes. "There was no evidence before this court to show that all meetings convoked by the respondents were in relation to strikes. It is my view that the order restraining the respondents from embarking on strikes will suffice. This relief is hereby refused," the judge stated.
