The Court of Appeal sitting in Enugu yesterday restrained the Inspector General of Police, Mr. Tafa Balogun, from removing from office Anambra State Governor, Dr. Chris Ngige, or acting in any matter preventing or further obstructing him from the performance of his duties. A suspended member of the Anambra State House of Asse-mbly, Mr. Nelson Achukwu, had in suit No: E/543m/2003 instituted at the Enugu High Court sought among other things, a declaration that his right to personal dignity was violated on Ngige's instruction at the Peoples Democratic Party (PDP) zonal congress held in Enugu on December 6, 2003. He also sought an order that the Inspector General of Police be compelled to remove Ngige from office on the grounds that the governor resigned on July 6, 2003. The Enugu State High Court presided over by Justice Stanley Nnaji had on January 2, 2004 ordered the IGP to remove Ngige from office. Besides another order from an Awka High Court presided over by Justice F.C. Nwizu restrained the IGP from executing the order of the Enugu High Court. (This Day) |
