Dollar pay for ministers: Court rules on govt’s objection in Oct

A Federal High Court in Abuja will on October 17 decide whether or not to dismiss a suit instituted by Lagos lawyer, Chief Gani Fawehinmi over payment of salary in dollars to the Finance Minister, Dr Ngozi Okonjo-Iweala and her Foreign Affairs counterpart, Mr. Olu Adeniji

The court fixed the date last Friday shortly after counsel to the Federal Government; Chief Wole Awodein (SAN) concluded his argument on the preliminary objection challenging the suit brought by Fawehinmi.

In the objection, Awodein said Fawehinmi has no locus standi to institute the action since he has not been able to show sufficient interest or threat of injury he would suffer in the matter.

He also argued that the Federal High Court lacked the jurisdiction to entertain the case as constituted, saying the facts of the matter fell under Section 16 of the constitution that relates to fundamental objectives and state policy.

But Fawehinmi told Justice Binta Murtala Nyako that the court had jurisdiction to hear any matter relating to the breach of the constitution, saying the case was in respect of the infringement of the constitution regarding the salaries of the two ministers.

He explained that as a Senior Advocate of Nigeria who swore to defend the constitution, he has the right to institute legal action whenever there is a breach of the constitution.
