Hearing in Ibori’s case continues today By Rotimi Fadeyi, Senior Correspondent, Abuja and Tunke-Aye Bisina Reporter, Asaba Hearing continues today at an Abuja High Court in the case instituted against Delta State Governor, James Ibori, by two chieftains of the People’s Democratic Party (PDP). The hearing will resume just as the Delta State Government and the governor pledge their commitment to the course of justice and the judiciary in the country. Last Wednesday when the case came up before Justice Hussein Mukhtar, lead counsel to the governor, Milton Paul Ohwovoriole (SAN), demanded for the certified true copy (CTC) of the entire court record of the proceedings in the Bwari Upper Area Court concerning the case. Ohwovoriole made this request following the allegation of the Bwari Upper Area Court Judge, Awwal Yusuf, that Governor Ibori was the one he convicted on September 28, 1995 for alleged criminal breach of trust and negligence. Ibori, however, insisted that he was never tried by that court. Testifying before Justice Hussein Muktar, Yusuf said the governor was arraigned in his court and after pleading guilty to the charge against him, he was convicted. “I have no doubt in my mind that it was James Onanefe Ibori that was convicted”. Yet, as Ibori’s lawyer pointed out, Yusuf was not even sure of the case charge number as he mentioned conflicting numbers. But in a counter claim filed on his behalf on Tuesday by Dr. Alex Izinyon (SAN), the governor said that at no time in his life did he ever appear before Yusuf in the case number CR 81/95, or any other case, neither was he ever convicted by the said court on September 28, 1995 on the charges of negligent conduct and criminal breach of trust or any other charges or offence whatsoever, at any time.       Copyright� 2002.
