Contempt: UNICAL VC, Registrar Risk Arrest C/River From Amby Nneze in Calabar Vice Chancellor of the University of Calabar, Cross River, Prof. Ivara Esu and his Registrar may risk arrest for refusing to honour a court order which mandated the institution to allow the applicants (students) to attend lecture pending the determination of the case. The state High Court presided over by Justice Evaristus Uke in a suit No. HC/MSC 134/2004 had after hearing an application brought before it by 10 students of the faculty of medicine and suggery in a way of motion ex-parte, challenging their expulsion by the university authority, ordered a stay of action pending the determination of the substantive case. Applicants through their counsel, Fidelis Onyebueke had prayed the court for leave to enforce their fundamental rights as enshrined in section 36 of the 1999 Constitution of the Federal Republic of Nigeria. It was also prayed that the court should grant a stay of all actions or matters relating to or connected with the complainants by allowing the applicants to attend lecture, pending the determination of the case. These prayers were granted accordingly by the court. But in an apparent disregard of the court order, the university authorities paid deaf ear to the order and had refused to comply with the court order as the 82 students involved in the expulsion are still not allowed to go back to their studies.
