Code of conduct tribunal declines Kpakol's request

A PLEA to the Code of Conduct Tribunal by his lawyer that charges against former Chief Economic Adviser to the President, Dr Magnus Kpakol, be withdrawn was rejected yesterday by the quasi-judicial body.

Kpakol was charged with failing to comply with the provisions of Code of Conduct Bureau and the tribunals' act when he was appointed economic adviser.

He was also accused of refusing to declare his assets when he assumed office as the National Co-ordinator of Poverty Eradication Programme.

The Act requires political office holders to declare their assets on assumption of office and when leaving office.

The tribunal's chairman, Justice Bashir Sambo, in refusing the application for withdrawal, said that there was no evidence to show that Kpakol had complied with the laws.

"I cannot withdraw the charges because this man has not complied with the law. You the prosecutor must prove and provide substantial evidence before the accused person can be discharged," he said.

Sambo said that it was not the duty of the tribunal to wait for any counsel before it could commence proceedings.

The prosecuting counsel, Mr. Thompson Alotigbe, at the resumed sitting, told the tribunal to withdraw the charges against Kpakol on the grounds that he had complied with the laws.

Alotigbe said that Kpakol was earlier represented by a counsel, but later left before the commencement of proceedings.

The tribunal, which resumed sitting yesterday, adjourned further hearing in the matter to August 17.
