DETAINED Major Hamza Al-Mustapha, former Chief Security Officer (CSO) to late General Sani Abacha yesterday complained to an Ikeja High Court that is trying him alongside four others for alleged assassination attempt that he was seriously sick.
At the resumed hearing of their trial Al-Mustapha refused to stand up as it is customary in court for every one to stand up immediately the judge enters the court room.
While everyone in court was standing when Justice Joseph Oyewole entered the court room for the commencement of the day’s proceedings, Al-Mustapha remained on his seat which earned him a verbal query from the trial judge, who demanded an explanation from him (Mustapha).
In his response, Al-Mustapha said: “My lord, I am a very sick man, I have no strength, I managed to come to the court today sir. I am very very sick”.
The trial judge later directed the counsel to Al-Mustapha, Mr. Olalekan Ojo to start his argument on motions he filed earlier, seeking the disqualification of the court for lack of jurisdiction and the disqualification of the state Attorney-General Professor Yemi Osibajo who is leading the prosecution for alleged bias in his prosecution.
When the matter was called, Ojo told the court that he only had access to his client on Wednesday evening to get information from him in order to file a counter affidavit to the response of the state in the motions he filed.
According to him, he needed time to file his motion seeking to verify the correctness of the earlier proceedings before the court.
Professor Osibajo and other counsel in the matter confirmed that they have been served with the motion and prayed for a short time to file their own response to the motion.
The court subsequently adjourned the matter till July 22, 2004.
