Igwes' Murder: Prosecution Counsel Withdraws
From Charles Onyekamuo in Awka
The lead prosecution counsel in the trial of suspects in the murder of former chairman of the Nigerian Bar Association (NBA), Onitsha branch, Mr. Barnabas Igwe and his wife, Amaka has withdrawn from the suit.
The counsel, Mr. Ikenna Egbuna who was among the lawyers granted fiat by the State Attorney General and Commissioner for Justice, Mr. Nnoruka Udenchukwu (SAN) to prosecute the suit against the suspects by the Onitsha branch of the NBA stopped appearing about two weeks ago.
At the Aguata High Court where the suit is being heard, a new counsel announced appearance for the NBA when the matter was mentioned.
The new counsel, Mr. E. Chukwuma who now leads the NBA prosecution team simply told the presiding judge, Justice Cecilia Uzowulu that he had taken over.
No reason was given for the withdrawal of Egbuna, but THISDAY learnt that his action might not be unconnected with the fall-out of the association's branch chairmanship election which he lost about forthnight ago.
The trial judge, Uzowulu reiterated her position that the prosecution was not inspiring an accelerated trial of the matter because of what she referred to as "unnecessary prayers for adjournment," adding that she may be compelled to grant the accused persons who had been in detention now for nearly two years bail. She said the action of the prosecution was unjustified and deliberately programmed to delay the suit.
Chukwuma acknowledged the judge's observation saying that the NBA's poor responses to the fiat to prosecute the matter contributed largely to the perceived delay and prayed the court to strike out some names of the 11 lawyers granted fiat.
"My lord, you see this matter will move faster if we remove some names of lawyers from this fiat, we have up to four Senior Advocates of Nigeria granted fiat but they have not shown up except Dr. Onyechi Ikpeazu (SAN)," he said.
