Osibajo to reply Al-Mustapha today By Victor Efeizomor Law Reporter   The Lagos State Attorney-General and Commissioner for Justice, Professor Yomi Osibajo (SAN), will today respond to the legal submissions of Major Hamza Al-Mustapha, former chief security officer (CSO) to the late Head of State, General Sani Abacha, asking the trial judge to decline jurisdiction over the case of attempted murder on The Guardian publisher, Mr. Alex Ibru. Mustapha’s counsel, Mr. Olalekan Ojo, had filed a motion asking Justice Joseph Oyewole to withdraw from the case over bias in the matter. Mustapha is also asking Osibajo to withdraw from subsequent hearing on the matter because he is bitterly biased toward him. The first motion regarding the disqualification of Oyewole was supported by a 13-paragraph affidavit in which Al-Mustapha claimed that the judge had demonstrated through his conduct and utterance, prejudice against him and acting in favour of the prosecution. He also alleged that Oyewole had refused him access to the documents and materials that he required for the preparation of the case.       Copyright� 2002.
