Court Confirms Ebonyi CJ's Dismissal

Justice A. A. Gumel of the Federal High Court, Enugu has struck out the case instituted by the former Chief Judge of Ebonyi state, Justice Edward Isuama against the state Judiciary, Ebonyi state government, the Governor of Ebonyi state, Dr. Sam Egwu, the state House of Assembly and the National Judicial Council (NJC) against his removal as the state Chief Judge in September 2000.

The case was struck out last week at the Enugu High Court for want of jurisdiction and the presiding judge, Justice Gumel asked Isuama to pay a total cost of N6,000.00 to the defendants in the suit for wasting their time over the years.

The former Chief Judge of Ebonyi state has instituted suit No. FHC/EN/CP/ 188/2000 against the aforementioned bodied and persons questioning his removal and praying the court that he should be reinstated and damages paid for the embarrassment he suffered over his removal.

But in striking out the case the Federal High Court refused all the relieves /prayers sought by Isuama in the Suit which includes among others his restoration to his former position as the Chief Judge of the State.

It is worthy of mention that Mr. Isuama was removed from office in September 2000 following his actions which were allegedly unbecoming of a State Chief Judge including alleged high handedness, corruption among others which were alleged to be at the point of derailing the judicial system of the State before the Nigerian Bar Association (NBA) Abakaliki Branch, petitioned the state government which in turn took the case to the state House of Assembly, which legislated the former Chief Judge�s removal after alleged due investigations of his activities.

During the trial of the suit, which lasted nearly four years, Isuama was represented at the time of the ruling by his lawyer, Mr. Onwuenwunor Clement while Ebonyi State Government was represented by a team of lawyers led by Chief A.N. Anyamene (SAN) and including Mr. O�Connell Ogbonna of the State Ministry of Justice, Mrs. Nkechi Ogbodo and C.R. Ibekwe.

THISDAY gathered that the case was struck out for lack of jurisdiction, although the former judge in charge of the case in the High Court was to deliberate the merits of the case before he was replaced by Justice Gumel who struck out the case.
