N10m Suit Against CDB: Court Adjourns Nov From Charles Onyekamuo in Awka An Onitsha High Court presi-ded over by Justice Chinwe Iyizoba, has adjourned to November 10, 2004, a suit against the Co-operative Development Bank Plc (CDB) by an Onitsha-based company, Emjost Enterprises Limited, for breaching a contract occasioned by an alleged irregularity in its (Emjost) account. In a suit no. 0/147/04 filed on behalf of the plaintiff, by J.E.O. Ogbuli, against the bank on May 12, 2004, the company is asking for a mandatory injunction on the bank to reverse all the irregularities in the plaintiff's account including unlawful interest, uncredited cash lodgements, unauthorised transfer, excessive interests and commission on turnover, as well as a declaration that the bank had been carrying on false, unlawful, illegal and unauthorised transactions in the said account. The plaintiff claimed that it had been operating the said current account no. 012003200 86000 with the banks Onitsha's branch, since 1999. The plaintiff claimed that the bank on or about June 29, 2000 granted it a N3 million overdraft facility which was later enhanced to N15m by the bank upon an application on or about June 26, 2001 after agreeing on the collateral which are all landed properties.
