Tribunal Strike out KWSIEC's Motion kwara From Tunde Sanni in Ilorin Kwara State Independent Electoral Commission (KWSIEC) has lost yet another of its legal moves to scuttle the election petitions of the national secretariat of the Peoples Democratic Party (PDP). The electoral body, had penultimate week, lost the legal battle at the Appeal Court sitting in Ilorin, to have the election petition of the party on the rejected chairmanship candidates for eight councils struck out. The election petition tribunal following the dismissal of the electoral body's appeal also struck out the motion brought by the electoral body for a stay of proceedings. Counsel to KWSIEC, Mahmud Gaffar, has brought the motion for a stay of proceedings while the appeal of the electoral commission subsisted at the appellate court. Justice Adetunji Bamgbola, who delivered the ruling of the tribunal, remarked that the balance of justice weighed against the motion and hence struck out the electoral body's argument. The tribunal observed that granting of stay of proceedings affects all other consolidated petitions then set aside three days, for definite hearing of the petition. The loss of the electoral body at the Appeal Court provoked the amendment of the state Electoral Law by the state House of Assembly. The passage of the amended electoral law has however come under sharp criticism by various interest groups within the ruling PDP. The Assembly, through its Majority Leader, Alhaji Kayode AbdulWahab Omotoshe, has however debunked the claims, maintaining that the amendment was done in good faith and after its attention has been pointed to it.
