Court Slams N2m Damage Against Govt Oyo From Ademola Adeyemo in Ibadan Oyo State High Court Sitting in Ibadan has awarded the sum of N2 million against the Oyo State government and its agent, OSOAGA for removing and destroying bill boards belonging to members of the Outdoor Advertising Association of Nigeria (OAAN). Members of OAAN had dragged the state, OSOAMAG and Alhaji Lateef Ishola to court claiming N50 million as damages for removal and destruction of their bill boards in Ibadan by agents of the state. They also sought an order from the court to restrain the government and its agents from further removal of their bill boards or collection any form of money as levies or rents from members of the body. In her judgment, Presiding Judge, Justice Bolaji Yusuff ruled that only local governments are entitled to collect advertisement fees according to the judge, under the laws of the land including the 1999 constitution, the authority vested with the power to control and regulate the practice of outdoor advertising resides with local councils. The judge said that the defendants committed a wrong by employing self help rather than setting judicial officials in motion contrary to the provisions of section 29 of the state land laws of Oyo State. He added that the defendants also committed trespass by removing the plaintiff's bill boards errected on the federal high ways over which the state government has no control. The court condemned the state for removing the plaintiff's bill boards and declared that the control and regulation of outdoor advertising by the state through its agent is illegal.
