An Osun State
High Court has ordered the state government to return a Toyota Prado Jeep
forcefully recovered from the former Chairman of Ila local government
area of the state, Mr. Biyi Adedotun. The court also adjourned the case
of house breaking and damages filed by the former council chairman
against the state till July 27.
The former chairman sued the
Osun State government to court for alleged forceful breaking into his
house to recover the Toyota Prado Jeep purchased by the Association of
Local Government of Nigeria (ALGON) for use by the then officials of the
association.
Joined in the suit filed at
the state High Court Osogbo was the state commissioner for Local
Government and Chieftaincy Matter, Attorney general and commissioner for
Justice and the state Police commissioner.
In the 15-paragraph affidavit
to support his claims, the former council boss prayed the court to award
N20 million to him as damages caused to his house and members of his
family when the vehicle was being recovered by agents of government.
Adedotun averred that he was
not around when some men who identified themselves as agents of the state
government accompanied by uniform Mobile Policemen visited his house at
Okinni along Ilobu road to recover the said vehicle.
He said the people allegedly
damaged his property in the course of recovering the Toyota Prado jeep as
well as subjected members of his family to series of trauma.
The former council boss said
as National Vice-Chairman of ALGON, the Prado jeep was allocated to him
to facilitate the performance of his official duties and that before the
ALGON National Executive Council was dissolved ”a decision was taken to
sell the jeep to any interested official.”
“Subsequently the plaintiff
applied and upon the payment for the jeep, ALGON issued a confirmation of
ownership of the said vehicle in the applicant name,” he said.
In his ruling, the trial
judge, Justice Akanbi, ordered that the jeep be returned to Adedotun and
adjourned the case of damages brought up by the plaintiff to July 27.
