Court Adjourns EWI's Appeal Till Sept 29 By Gboyega Akinsanmi A Court of Appeal sitting in Lagos has adjourned till September 29 the substantive appeal between Econet Wireless International and Vmobile Nigeria Limited, formerly referred to as Econet Wireless Nigeria. EWI alleged the respondent in its notice of appeal that it refused to transfer 51 per cent equity to the appellant as entrenched under the Article of Association as right of preemption and rescinded its 5 percent equity unconstitutionally. The three-man panel headed by Justice James Ogebe along with Justice Dattijo Muhammad and Justice Pius Aderemi gave counsels to the parties14 days to prepare written submissions on the respondent's application for preliminary objection. Justice Ogebe, in his ruling, gave the order after respondent counsel, Chief Olaniwun Ajayi informed that he had an application of preliminary objection aimed at determining if Lagos High Court has power to entertain the suit before it. Counsel to the appellant, Professor Alfred Kasunmu (SAN), however argued that the court should set aside the respondent's application on the ground that the application lacked merit and had no competence. Kasunmu (SAN) informed the court to strike out the application because the motion of mandatory injunction was still pending before the court.
