Commission Boss Chides Defence Lawyer

Chairman of the Judicial Panel of Inquiry into Local Government Councils between May 1999 to May 2003 in Kwara State, Justice Oluyemisi Ajayi has frowned at the choice of word of a defence lawyer, Mr. Rashidi Ijaodola appearing before the commission.
Ijaodola, who appeared before the commission for the former Directors of Personnel Management (DPM) of the 16 local governments had objected to a witness giving evidence in respect to the commission, Chief Wole Olanipekun (SAN).
Facing the commission, the defence counsel said "your lordship", in the interest of justice (which he repeated several times) we all have confidence in your integrity and your commission but we want the law with respect to the admissibility of the evidence".
An apparently exasperated judge fired back at the counsel, "shut up, don't talk about my integrity, mind your language this commission is operating within the law that is recognised by the constitution and I will take evidence from the witness".
Shortly before the interjection of Ajayi, the defence counsel had asked the commission to reject the witness, Mr. Marodeyo Bukoye who was the head of the chartered accounting firm that audited the finances of Irepodun, Isin, Oke-Ero and Ekiti local government areas.
Ijaodola based his objection on the ground that any audit report on such issue must emanate from the office of the Auditor-General of the state and not a private firm that has no constitutional power under section 125 of the 1999 constitution.
Lead counsel to the panel, Olanipekun (SAN) had said he refrained from joining issues with the defence counsel because such would amount to delaying the assignment of the commission, which he said was a fact finding one which should not entail stringent rules and procedures of the normal law court.
Ajayi later ruled on the admissibility of the audit reports as presented by Moradeyo which were marked as exhibits.
