Ex-NIM President Wants Power of Attorney Revoked

Former President of Nigeria Institute of Management (NIM), Chief Olukolawole Akinyemi (plaintiff) has insisted on the revocation of the power of attorney he had earlier handed to a Lagos lawyer, Mrs Abiola Morgan-Anyakwo (defendant), concerning continued administration of his estate; claiming he was suffering from the action.
Akinyemi, 78-years-old and diagnosed with Alzheimer disease, had through his counsel, Mr Biodun Bakare, prayed a Lagos High Court, Lagos Judicial Division, Igbosere, to also help him reclaim his passport from Morgan-Anyakwo, to enable him return to the United Kingdom for treatment.
At the last hearing before Justice Candide-Johnson, both defendant and plaintiff counsels gave the court an up to date briefing on Anyakwo's administration of Akinyemi's estate and a proposed out-of-court settlement move.
While Mr Opeyemi Akangbe from Babalakin & Co firm, defendant' counsel, informed court of an earlier meeting and asked for another adjournment, pending which both parties would have discussed and conclude outstanding issues, Bakare claimed the issues were still largely un-resolved.
"True we had a meeting where all parties were present. At the meeting, we asked for plaintiff's passport, funds for medical care, his return to England, and complete withdrawal of Morgan- Anyakwo as administrator. Defendant's counsel had suggested a member of the committee of friends to take over, but we do not have any confidence in the committee. Since then, no other meeting has been called and the plaintiff is suffering", Bakare disclosed.
Candide-Johnson, in an earlier ruling, had ordered Morgan-Anyakwo, who currently holds Akinyemi's power of attorney over his estate, to pay him N231,000 monthly, from August 2003 till March 2004 (seven months), for his monthly upkeep, pending the determination of the substantive suit .
Morgan-Anyakwo had filed an appeal and also applied for a stay of execution of the court ruling, pending the determination of the appeal. In her statement of defence, she alleged that the plaintiff (Akinyemi) was of unsound mind, and lacked the capacity to institute the action.
