419:Anaejemba's Application for Hearing June 23 Lagos A Federal High Court, Lagos has fixed June 23, for hearing in an application filed by Mrs Martina Anaejemba, seeking for the enforcement of her fundamental human rights. Anaejemba is among those standing trial before an Abuja High Court for alleged involvement in $242 million Advance Fee Fraud (a.k.a. 419). In the suit filed through her counsel, Chief Rotimi Williams, SAN, Anaejemba asked the court for the enforcement of her fundamental human rights, following her arrest and detention in Lagos by the police and the subsequent criminal proceedings against her in Abuja. Joined as defendants are the Attorney-General of the Federation, the Economic and Financial Crimes Commission (EFCC) and the Inspector-General of Police. The plaintiff who has been standing trial since February 5, is asking the court to restrain the police from re-arresting, detaining or removing her from Lagos State or anywhere else in Nigeria for trial in any other territory outside Lagos. She claimed in an originating summons, that she was arrested while complying with a police invitation without the least knowledge of the offence which she committed. But the defence in their preliminary objection dated March 14, asked the court to decline jurisdiction to entertain the case on grounds among others;that the suit constituted an abuse of court process and that the Federal High Court has no supervisory jurisdiction over the High Court of state and the FCT.
