Ibori: Court summonses chief judge, four others

A Federal Capital Territory High Court has subpoenaed the Director General of the Department of the State Security Service, Col. Kayode Are (rtd) and the Chief Judge of Abuja, Justice Lawal Gumi, to testify in the identification trial initiated against the Governor of Delta State, Chief James Onanefe Ibori.
The trial, which continues on Wednesday in Abuja, is to identify the actual person tried and convicted by a Bwari Upper Area Court in Bwari, Abuja on September 28, 1995.
The court also subpoenaed a commissioner with the Independent National Electoral Commission to come and tender some records in the possession of the commission.
Awal Yusuf, the judge who tried one James Onannefe Ibori in 1995 at the Bwari Upper Area Court and the Secretary of the National Population Commission who is summoned in his official capacity.
All the people subpoenaed are expected to appear before Justice Hussein Murkthar who issued the subpoena at the instance of two Peoples Democratic Party�s Chieftains, Goodnews Agbi and Anthony Alabi.
In a statement of defence field by them, they argued that Ibori was qualified to seek reelection to the office of Delta State Governor.
They said that the certified true copy of the judgment of the Bwari Upper Area Court was inadmissible to prove that Governor Ibori was the person actually convicted.
But the Plaintiffs averred in their statement of claim that one Jmaes Onanefe Ibori was convicted on September 28, 1995 at the Upper Area Court in Bwari of negligent conduct and criminal breach of trust and sentenced to one-year imprisonment or N1000.00 fine.
The statement of claim which was filed on behalf of the Plaintiffs reads, �The plaintiffs aver that James Onanefe Ibori was convicted on September 28, 1995 as stated in the proceeding paragraph was the same James Onanefe Ibori who is the incumbent Governor of Delta State.�
The Governor in his statement of defence filed by Chief FRA Williams denied all the allegations and thereby joined issues with the plaintiffs.
Chief Gani Fawehinmi would be in court to personally handle the matter, one of his aides confided to our correspondent.
The Supreme Court had on February 6 ordered that another judge should try the suit by the two PDP chieftains.
By so doing, the apex court endorsed the judgment of the Court of Appeal, which earlier made a similar order.
Meanwhile, the PDP National Chairman, Chief Audu Ogbeh, and the party Secretary, Chief Vincent Ogbulafor, have risen in defence Ibori.
