Court Frees Accused Persons, 5 Years After From Tunde Sanni in Ilorin Two accused persons, Raphael Adebola and Hameed Azeez standing trial for criminal conspiracy, breach of trust and forgery before an Ilorin Chief Magistrate Court have regained their freedom. Discharging the accused persons, trial magistrate, Mrs. Halimat Saleeman, berated the police for not concluding investigation into the case since 1999. According to police prosecutor, the accused person being accountant and cashier officer of Olalomi Community Bank, Offa, Kwara State were allegedly between January and June 1998 conspired together and embezzle N211,388.73. At the resumed hearing of the case, Inspector Moshood Balogun leading police prosecution had sought for another adjournment to enable police conclude investigations and open its case. The trial magistrate surprised by yet another request for adjournment turned down the request and criticised the command for deliberately delaying justice. "This is a 1999 case and we are now in 2004. Up till now the police have not deemed it fit and proper to conclude investigation." "If investigation cannot be concluded in five years, I wonder if that investigation will not go on till eternity. Justice delayed, they say, is justice denied," she said. She stated that the accused are entitled to justice and cannot allow the police to hang a criminal case on their neck indefinitely. "For this reason, the case is accordingly terminated against the accused for want of prosecution. They should not be re-arrested without the prior consent of the court," she maintained.
