Dope: Montgomery to Appeal American sprinter Tim Montgomery is set to take his doping case to the Swiss-based Court of Arbitration for Sport. The world 100m record-holder has opted to appeal direct to the international body rather than the US Anti-Doping Agency, which brought the charges. "We believe USADA's conduct has removed any confidence Tim could be fairly treated," his lawyer Howard Jacobs told the San Jose Mercury-News. Montgomery denies all charges and hopes to compete at Olympic trials on 9 July. The CAS decision would be final but may not be reached before the start of the trials. Under USADA protocol, persons charged with a doping offence may accept a ban, or seek either a hearing before an American Arbitration Association panel comprised of North American members of the Court of Arbitration for Sport (CAS) or go directly to the Swiss-based CAS. Montgomery would be the first athlete in USADA's three years of existence to skip USADA's arbitration system and go directly to the court of last appeal. Montgomery is one of four American athletes who USADA have written to alleging possible doping violations following verbal evidence given to the federal investigation of the Bay Area Laboratory Co-Operative (Balco).
