Appeal Court Upholds Nnamani's Election

Legal tussle over the re-election of Governor Chima-roke Nnamani of Enugu state has finally come to an end, as the Appeal Court sitting in Enugu state yesterday upheld the lower tribunal’s verdict. The All Progressive Grand Alliance had appealed the judgment of the tribunal after the Justice Abdul Aboki-led panel of the National Assembly/Governo-rship and Legislative House Tribunal, on March 30, 2003 declared Nnamani as having been duly elected for a second term. APGA had claimed at the tribunal that its gubernatorial candidate, Mr. Ugochukwu Agballa was the real winner of the election. But in a 30 minutes judgment read by Justice Walter Onoghen, the panel unanimously upheld the decision of the lower tribunal, and further dismissed the appeal of the APGA candidate with a cost of N5, 000 against the appellant. According to the panel, the appellant failed to provide “admissible” evidence to prove allegations of excess votes and electoral irregularities, which were major issues of the appeal. "Presentation of the appellant's counsel, no matter how brilliant, cannot take the place of evidence," Justice Onoghen said, adding that the panel found no merit in the appeal. When the court rose at 10.00 a.m. supporters of Nnamani and PDP faithfuls erupted in jubilation outside the court premises, praising the judiciary for upholding the rule of law. Secretary to the State Government, Dr Dan Shere, who witnessed the judgment said: "I think it is not just a victory for Nnamani, it's a victory for democracy and the rule of law in Nigeria. It's a victory for the people of Enugu whose mandate is being challenged. We thank God for the support of the people, which Governor Nnamani has never taken for granted."
