Ukachukwu Vs Uba: Ruling On December 2

Court of Appeal sitting in Enugu will on December 2, end the long drawn legal battle between Senator-elect Nicholas Ukachukwu and Ugochukwu Uba, over who would represent the people of Anambra South Senatorial district in the senate. Anambra elections tribunal had nullified Uba’s election and declared Ukachukwu as the winner of the national assembly elections held in the zone in 2003. Reacting to the development, Ukachukwu said he believes that all will go well in the case, "I believe God that all will go well, though I hear my opponents have been going about boasting that their contacts in the villa have called the judges to give ruling in their favour. "This notwithstanding, I am not bothered with all these propaganda. My case is very simple. The Appeal Court panel, led by Justice Salami had ruled that the case is inconclusive, that the so called judgement of the former panel led by Justice Opene was an aberration and that it should not be sited in any court of law in the country.” More importantly, Ukac-hukwu said the fact that one of the judges that sat alongside Opene in the case has come out to openly testify before the National Judicial Council that Opene lobbied him to allow the appeal to succeed, further spoke volumes in his favour. "He said Opene told him that a governor is interested in the case," Ukachukwu said, adding, "this will be the first time that a seasoned judge will come out and openly testify against his fellow judge." Ukachukwu, a former member of the House of Representatives, however reaffirmed his confidence in the ability of the judiciary to deliver in times like this. "I still believe in the judiciary as the last hope of the common man and that come December 2, God will make a name for himself, because my opponent did not contest election, was not declared by INEC. I contested, was declared winner and issued with certificate of return, so I have nothing to fear," he added.
