Egwuatu vs Ofodile: Court Adjourns Judgment

National Assembly Election Petition Tribunal sitting in Awka, Anambra State, has adjourned sine die judgment in petition No: EPT/AN/NA/5/03, Chief O.C. Egwuatu and INEC, Offodile and four others and EPT/AN/NA/1/03, Dr. Okechukwu J.M. Onwudinjo and Chief O.C. Egwuatu and eight others. The indefinite adjournment followed presentation of addresses by parties involved. Both Petitions are consolidated. Chief Egwuata, the Peoples Democratic Party (PDP) candidate for Awka North and South Federal Constituency in the April 12, 2003 National Assembly elections was initially declared winner and returned by the constituency returning officer, but had his election cancelled through a press statement by the then Resident Electoral Commissioner (REC), Alhaji Hassan Sulaiman on April 18, 2003. The REC latter awarded victory to Mr Chudi Offodile citing obedience to a certain court order obtained by Offodile and others on April 11, 2003, the eve of the election. Egwuatu had petitioned the Awka tribunal asking it to declare him the PDP candidate who was sponsored by the party, screened by INEC and contested the election which he won and was issued with form EC8E(1). In the address presented to the tribunal on his behalf by Chief Chimezie Ikeazor (SAN), Chief Egwuatu in EPT/AN/NA/5/03, said the principal issues for determination arising from the petition included whether the tribunal has jurisdiction to entertain the petition, and who between the petitioner (Egwuatu) and the fifth respondent (Offodile) was the PDP candidate for the said election, duly screened, cleared and his name poublished by INEC, and who eventually won the election. The facts of the issue, he said, need only to be proved on the balance of probabilities and not beyond reasonable doubt, adding that the petitioner had proved his case even beyond reasonable doubt that he was "duly sponsored, duly screened and cleared and that his name was published and that he contested the said election, won and was declared winner."
