Appeal Court Orders Duke to Present Certificates

Certificate scandal allegation against Cross River State, Governor Mr Donald Duke reached a crescendo, yesterday, as the Court of Appeal sitting in Calabar, ordered him to present the originals of his academic and professional certificates to the National Assembly/ Governorship Election Tribunal sitting in Calabar. The appellant, Ambassador Ade Akpang Odu, who was also the governorship candidate of the National Democratic Party (NDP) during the April 19, 2003 gubernatorial elections had appealed the judgement of the election tribunal which refused to subpoena the governor to produce his original certificates. Delivering judgement yesterday, the lead judge, Justice Monica Dongban-Mensem held that nothing was wrong for the governor to produce the originals of his certificates which he claimed to have obtained. Obi Odu had challenged the decision of the Election Tribunal which set aside the subpoena order it had earlier placed on the governor to produce before it, the original copies of all certificates of schools he claimed to have attended and graduated from. But the Appeal Court, comprising of four other judges namely Justices Baba Alkali Ba'aba, Aloma Mallam Mukhtar, Dattijo Muhammad and Jane Omokri were unanimous in the judgemnet in suit number CAC/CRS/C/GOV/EPA/32/2004. In the ruling, the Court held that it was necessary for Duke to tender certificates to clear the suspicion, which the judgement of the tribunal had caused, concerning his academic qualification. According to it, "what is wrong in asking a man to produce his certificates? every person who had gone to school and graduated should proudly present his or her certificates whenever asked to do so."
