Colonel Francis Adekunle Fajuyi, first military governor of the defunct western Region, have dragged each other to court over the Adekunle Fajuyi Family Estate in Ado-Ekiti, the Ekiti State capital.<o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">The two sons, who are legal practitioners, are Mr Donald Oluwafemi Fajuyi, who is the secretary and legal adviser to the State Housing Corporation and Chief Stephen Adedayo Fajuyi, a private legal practitioner in Ado-Ekiti.<o:p></o:p></SPAN></P> <P class=MsoBodyText3 style="TEXT-INDENT: 8.95pt"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">Before seeking<SPAN style="mso-spacerun: yes">&nbsp; </SPAN>redress from the court, the Ewi of Ado-Ekiti Oba Rufus Adejugbe had intervened in the family dispute but Donald, who allegedly discovered that his brother did not comply with the Ewi s directive dragged Adedayo to court along with five others, believed to be members of either Adebolu<SPAN style="mso-spacerun: yes">&nbsp; </SPAN>or Adekunle Fajuyi family.<o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">The five defendants are Pa. Joel Adebolu, Captain Adedara Fajuyi (rtd), Folorunso Oluyemi, Akin Adebolu and Dele Adeluyi.<o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">The two sons had each been appointed as commissioners at different times in the eight-year- old Ekiti State. Donald served as commissioner for Commerce, Industry and Tourism under Navy Captain Atanda Yusuf while Adedayo, who was one-time chairman of Ado-Ekiti Local Government, also served as Attorney General and Commissioner for Justice under Governor Adeniyi Adebayo of the Alliance for Democracy (AD).<o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">According to the statement of claims at the customary court Ado-Ekiti, Donald who is not asking for financial reward, prayed the court to restrain his brother and five others  jointly and severally, from further publishing, producing, and distributing or effecting in anyway the documents titled  Resolution of Adebolu Family on Adekunle Fajuyi Family Estate dated March 22, 2004, and signed by the 1st through 5th defendants on behalf of the 6th defendant either by themselves or through agents or proxy. <o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">He averred that doing otherwise would be  contrary to the directives of the Ewi of Ado-Ekiti made at his palace on 9th March 2004. <o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">Donald alleged that the document  was made recklessly, maliciously, negligently, without due care and investigation, unreasonably, and in bad faith with a hidden agenda. <o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">He is also seeking  an order compelling the defendants to give effect to the directives of the Ewi of Ado Ekiti at his palace on 9th March 2004 as reflected in the plaintiff s letter to the Ewi dated 30th March 2004 titled  objection to resolution of Adebolu family members on Adekunle Fajuyi Family estate dated 22nd March 2004.  <o:p></o:p></SPAN></P> <P class=MsoNormal style="TEXT-INDENT: 8.95pt; TEXT-ALIGN: justify"><SPAN style="FONT-SIZE: 11pt; FONT-FAMILY: Arial">He is further seeking a  declaration that on the document titled  Objection to resolution of some Adebolu Fajuyi members on Adekule Fajuyi Family Estate dated 22 March 2004, the defendants are not entitled jointly or severally to engage in the deliberations or distribution of property of late Lt. Col.
