    Al-Mustapha needs surgery —Lawyer

    COUNSEL to Major Hamza al-Mustapha, former Chief Security Officer (CSO) to the late Head of State, Gen. Sani Abacha, told the Ikeja High Court yesterday that his client is to undergo leg surgery soon.

    The counsel, Mr. Olalekan Ojo, alleged that the need for surgery arose following gun shot injuries al-Mustapha sustained while he was being led away from Kirikiri Maximum Security Prison, Lagos, by officials of the Directorate of Military Intelligence (DMI) on March 31 this year.

    Ojo insisted that the former CSO’s personal physician must be present during the surgery.

    Together with former Chief of Army Staff (COAS), Lt. Gen. Ishaya Bamaiyi, former Military Administrator of Zamfara State, Col. Jubri Bala Yakubu (rtd), former Lagos State Police Commissioner, Mr. James Danbaba and retired Chief Superintended of Police (CSP) Muhammadu Rabo Lawal, al-Mustapha has been standing trial since 1999 for the attempted murder of The Guardian publisher, Mr. Alex Ibru during the Abacha regime.

    The former CSO and his colleagues have, also since 1999, been remanded in the prison from where the DMI took him away for investigations into allegation of involvement in a security breach.

    The government had denied media reports at the time that al-Mustapha was shot.

    Mr. Ojo intimated the court that the Army had concluded plans for al-Mustapha to undergo surgery to be carried out by its medical experts.

    Ojo made his announcement shortly after the judge, Justice Joseph Oyewole, ruled against his application for stay of proceedings.

    Al-Mustapha had earlier filed an application for the court’s order directing the DMI and the State Security Services (SSS) to grant access to his personal physician for an urgent medical attention.

    But Oyewole ruled that he could not find any special circumstance justifying the prayer for a stay of proceedings, saying it was clear that granting it would cause great hardship to all involved in the trial.

    Oyewole adjourned further hearing in the case to October 11 this year.
