Kano court faults removal of Emir

A Kano High
Court, presided over by Justice Saka Yusif, has ruled that the removal of Sarkin
Dawaki Mai Tuta, Alhaji Aminu Babba Dan Agundi, by the Emir of Kano, Alhaji Ado
Bayero as a king maker, was faulty.
Delivering judgement last Monday, in Kano,
Yusif posited that proper procedure was not followed in the removal of the
Sarkin Dawaki Mai Tuta, Alhaji Aminu Babba Dan Agundi.
He noted that, necessary steps for the
appointment and installation of the new Sarkin Dawaki Mai Tuta and District head
of Gabasawa, was yet to be finalised as his turburning and other necessary rites
for appointment to that office have not been done.
It will be recalled, that Alhaji Aminu
Babba Dan Agundi, sued the Emirate Council and the Emir of Kano, Alhaji Ado
Bayero on his removal a day after his suspension as a king maker last year.
Justice, Saka posited that, Aminu Babba,
who is an employee of the local government council by the virtue of his position
as a king maker, had not record any termination later showing that his
appointment is no longer needed by the local government.
He reminded that, the Kano State
government white paper on chieftaincy appointment and Ruling Houses was specific
that, only Jammo Babba House will inherit the Sarkin Dawaki fit as against the
Emir of Kano Ado Bayero�s action of appointing an outsider.
He then averred that no evidence was
tendered before him as proof that both the local government and the state
government gave their blessing on the removal of Alhaji Aminu as Sarkin Dawaki
Mai Tuta.
Justice Saka, therefore granted all the
relief sought by the plantiff of an injunction restraining the Emir of Kano,
Alhaji Ado Bayero and the Emirate council from taking any further action on the
dismissal of Alhaji Aminu Babba and the appointment of his successor, until the
determination of the main suit before the court.
