Kwankwaso urges court to
restrain panel from probing him

The
Minister of Defence, Rabiu Musa Kwankaso has gone to a Kano High Court
seeking for an order restraining the probe panel into activities of Kano
State government when he was the state chief executive, from compelling
him to appear before the commission.
The
judicial commission of inquiry was set up for the purpose of subjecting
him to public questioning on allegations involving whether or not he
misappropriated public funds.
Already,
Kwankwaso�s counsel, Chief Afe Babalola (SAN) has written a letter to the
Chairman of the commission informing him that there is a case on it
pending in court. In the letter dated October 22, 2004, Babalola told the
commission to suspend hearing until the determination of the application
before the High Court.
He said
further, �as you are no doubt aware, the commission of Inquiry set up by
the Kano State Government is an inferior court subject to the supervision
of the High Court of Kano State�.
�As
officers of the judiciary, legal profession and the state, who have sworn
to uphold the rule of law and maintain the integrity of our courts, there
isvalidly any need to remind you not to do anything that would foist on
the High Court of a state of helplessness or render nugatory whatever
decision the High Court might come to in the pending application�, he
added.
Babalola
further reminded the commission that since the necessary processes had
been served on them , the only option open to the commission was to
suspend hearing until the determination of the application before the High
Court.
In the suit
filed at a Kano High Court, the governor of the state; Mallam Ibrahim
Shekarau; the chairman and members of the commission were joined as
defendants.
