KENNETH OFOMA, Abakaliki
AN Abakaliki
Magistrate’s court has granted bail to 30 members of the Movement for the
Sovereign State of Biafra (MASSOB) who were arraigned before it on Thursday.
The MASSOB members were charged with,
among other things, conspiracy to commit felony, attempt to commit treason, as
well as attempt to cause breach of the peace by shouting slogans that they are
Biafran and not Nigeria.
The MASSOB activists were charged after
they had spent five months in detention in Abuja, without trial.
When the matter was brought up in court,
the counsel to the accused persons, Messrs C.E. Eze, C.E. Omukwu and M.E. Igwe
asked for bail of the accused persons, stating the applicable laws in respect of
the case.
The Magistrate, Mrs U. Onyemenam, granted
bail to all the 30 on condition that they produce a surety with three years tax
clearance, affidavit of means, two passport photographs and N40,000 deposit.
The case with charge N2558c/2004 was
adjourned to November 18, 2004 for hearing.
Inspector Nkwagu Ugboka presented the
State Commissioner of Police, Dr Udo Udo Ubam as the prosecutor.
Speaking to Daily Champion on the
matter, the Area Chief Provincial Administrator of MASSOB in Ebonyi State, Dr
Linus Obirija Ogazi decried the "inhuman and unjust" treatment of the accused
persons by the government.
The MASSOB leader said that the 30 accused
persons were arrested on May 27, 2004 at Ohaukwu Local Government Area of Ebonyi
State and taken to Abuja where they were clamped in detention without trial.
He said that on September 7 2004, a Kuje High Court, in
the Federal Capital Territory (FCT) presided over by Justice M. Balami had
ordered the respondents (government) to produce the applicants in court within
48 hours for them to be dealt with according to law. The High Court suit No. FCT/HC/M/4078/04
also declared the continued detention of the applicants as "unfair and
unconstitutional."
