Treason: 53 alleged MASSOB members sue FG

Fifty-three suspected members of the Movement for the Survival of the Sovereign State of Biafra (MASSOB) detained over treason allegations, Monday dragged the Federal Government to court seeking temporary freedom pending the determination of the criminal charges preferred against them.

In the summon application filed at the Federal High Court Lagos, pursuant to Section 118 (2) Criminal Procedure Act Cap 80, Laws of the Federation 1980, the Attorney-General of the Federation and the Inspector General of Police were named respondents.

The applicants averred through a 26-paragraph affidavit deposed to by a business woman, Mrs Gloria Okafor, said to be the biological mother of two of the detainees, that the suspects have no penchant for criminal behaviours, adding that there was no credible evidence linking them with the offence of treason.
According to the deponent, all the applicants were arrested on September 11, 2004 at the premises of Technical Secondary School, Abule Ado, Lagos State while playing football match.

It was further alleged in the affidavit that one of the detainees, who was about six months pregnant and a 80-year-old man, have been very sick in detention.
"The applicants are in serious need of medical attention and their present place of detention which is Ikoyi Prisons is not only poorly ventilated, highly congested with very poor arrangement for feeding and medical attention," it was added.

The Federal Government had on September 17, 2004 charged the applicants to the Yaba Chief Magistrate Court for alleged treasonable felony.
Ruling on the case, the trial Chief Magistrate ordered the accused persons to be remanded in custody pending their formal arraignment at the Federal High Court.
Further trial has been fixed for November 2, this year.
