Asaba — DIRECTOR of Public Prosecution (DPP) who is also acting as Solicitor-General/Permanent Secretary in the Delta State Ministry of Justice, Mr. Emmanuel Okirhienyefa Monday confirmed that the ministry has formally filed fresh charges of murder in addition to the armed robbery charge preferred against the four accused persons presently remanded at Ogwashi-Uku prisons over the alleged killing of late PDP chieftain, Chief A.K. Dikibo.
He told Vanguard in Asaba that “already, we have filed an application for consent at the Ogwashi-Uku High Court, to enable us prosecute them (accused) there. Immediately the court sends us reply, we will commence the case.”
The DPP however added that high courts in the state are presently on vacation and are expected to resume on September 27.
Meanwhile, an Ogwashi-Uku Chief Magistrate’s Court presided over by Mr. S.C. Ehikwe, where the initial three-count charge of armed robbery by the police was lodged, further adjourned the case on Monday till September 27 to enable the Ogwashi-Uku High Court resume from vacation and fully take over before discharging the case.
State Attorney-General and Commissioner for Justice, Prof. Amos Utuama had a week ago told reporters in Asaba that murder charges would be included, having carefully scrutinized the case file as charge of armed robbery was not sufficient.
When the case came up Monday, the third adjourned date before the Ogwashi-Uku Chief Magistrate’s Court, all the four accused persons were brought to the court by the prisons officials. They were Solomon Igbinedion (24), Onyeka Emordi (22), Chukwuyem Solomon (20) and Chinedu Boi (17). One of the three counts which the police earlier charged them with was that “you Solomon Igbinedion, Onyeka Emordi, Solomon Chukwuyem, Chinedu Boi and others at large on the same date and time along Ogwashi-Uku/Kwale Road on the 6th of February 2004 did rob Chief A.K. Dikibo with firearms and thereby committed an offence punishable under Section 1 (2) (a) and (b) of the Robbery and Firearms (Special Provisions) Act Cap 398 Vo. XXII laws of the Federation of Nigeria 1990.”
