ABUJA—AGAINST tradition, Presidential Election Petition Tribunal hearing an appeal filed by former Head of State, Major-General Muhammadu Buhari, challenging the electoral victory of Chief Olusegun Obasanjo in the last presidential election, is to sit six days of the week including Saturdays henceforth.
President of the Court of Appeal, Justice Umaru Abdullahi, who broke the news yesterday in Abuja at the resumption of hearing in the presidential election petition pending explained that its decision was informed by the need to cover enough ground and determine the appeal in good time.
Yesterday’s proceeding was witnessed by former World Court Judge, Prince Bola Ajibola (SAN), and Special Adviser to President Olusegun Obasanjo on Legal Matters, Chief Ojo Maduekwe (SAN).
They did not stay long in court, however. Lead counsel to President Olusegun Obasanjo, Chief Afe Babalola (SAN), who was a bit late to court yesterday, announced the appearance of the former World Court judge to the court, saying: “My lord, we have an important visitor in court.”
The four justices of the Court of Appeal hearing the case said they had seen him and Prince Ajibola stood up to bow for them. They bowed to him too in recognition and continued with the hearing of the election petition which they said they were determined to conclude very soon.
The tribunal had granted accelerated hearing in the matter before the Court of Appeal went on vacation.
By September 24, hearing in the matter would be one year old. The non-conclusion of the matter over one year after the results of the elections were declared by the Independent National Electoral Commission (INEC) has generated a lot of debate at different legal fora.
The usual explanation from the Appeal Court authorities is that the parties in the suit invited many witnesses and that it would be unfair to hear out a party with his witnesses without hearing the other party.
