Presidential Election Tribunal Increases Sitting Days

Presidential Election Petition Tribunal which resumed hearing on the appeal filed by All Nigeria Peoples Party's (ANPP) Presidential candidate in the April 19, 2003 elections, General Muhammadu Buhari, yesterday said it now sits six days every week including Saturdays in order to dispose of the appeal expeditiously.

The tribunal made this disclosure at the opening session of the tribunal also attended by former Judge of the World Court and one time External Affairs Minister, Prince Bola Ajibola (SAN) as well Chief Ojo Maduekwe, a Special Adviser to the President on legal and constitutional matters.

Before the Court vacated in July, ANPP invited a total of 139 witnesses to give evidence to prove that the election was marred by electoral malpractices.

President Olusegun Obasanjo on his part called 100 witnesses to counter the allegations.

Independent National Electoral Commission (INEC), which was joined as one of the 268 respondents in the matter called 27 witnesses as at yesterday, while no fewer than 170 witnesses were still being expected to give evidence in the matter.

As at 5:00p.m. yesterday, the court was still sitting and taking evidence from witnesses from INEC, which insisted that the commission conducted the presidential election in line with the Electoral Act 2002.

The petitioners claimed that the election was vitiated by substantial non-compliance with mandatory statutory requirements and irregularities; that INEC arbitrarily assigned scores to each of the 20 candidates that vied for the presidential election; that President Obasanjo was not even qualified to contest the election in the first place and that none of the candidates was entitled to be returned as winner of the election.
