AD Factions: Hearing Now September 21

A Federal High Court in Lagos has fixed September 21 for hearing, in an application brought before it by Chief Bisi Akande's faction of the Alliance for Democracy (AD), praying it to strike out the claims in the joinder application filed by Mojisoluwa Akinfenwa faction of the party.

Immediate past president of the Nigerian Bar Association (NBA), Chief Wole Olan -ipekun (SAN), who is the lead counsel for Akande at yesterday's proceedings, informed the trial judge, Justice Abdullahi Mustapha, of the application before the court, seeking to strike out the claims by the rival faction, on the ground that they are time bound.

Olanipekun also told the court that an agreement has been reached by the parties to resolve the matter out of court, but Ms Folashade Awofolaju, from the Chambers of Niyi Akintola (SAN), counsel to Akinfenwa, disagreed with Olanipekun, insisting that she was not aware of the agreement.

The Presiding Judge, who had on May 18, joined the Akinfenwa faction as necessary party to the suit, said he cannot reverse, but however fixed September 21 for arguments.

Akande had sequel to the refusal of the Independent National Electoral Comm -ission (INEC), to recognise the party's national convention held in Lagos on December 16, sued the electoral body, asking the court to compel it to recognise the convention, as well as the elected officers.

Akande's faction had also prayed the court to restrain INEC from according recognition to any other group.

But the Akinfenwa's faction which held its convention in Abuja, came before the court, asking to be joined as necessary party to the suit.

Their contention was that whatever order the court would make in respect of the Akande's suit, will affect them, as according to them, they are the group or persons which the Akande's faction sought to be restrained.

Although Akande's lawyer opposed the arguments, the court, on May 18, upheld the submissions of Awofolaju, who appeared for Akinfenwa's faction and joined the group as necessary party to the suit.
