Delta House axes NDDC chief
• Passes vote of no confidence

DELTA State
House of Assembly Wednesday passed a vote of no confidence on the commissioner
representing the state on the Niger Delta Development Commission (NDDC), Prof.
Victor Perefomode.
Prof. Petefomode had on the fourth count
after the last opportunity to appear before the Assembly Wednesday neglected the
summons by the House to account for the projects awarded and executed in the
state, location of such projects and their core beneficiaries in the state as
initiated by the commission.
The commissioner whose tenure will expire
next month (October), had in a letter to the House dated September 3, this year
through NDDC counsel, Eze .A. Nwa Uwa, said the state legislature lacked
constitutional or legal backing for its resolution inviting him "for the purpose
of supplying the requested information".
He cited relevant sections of 1999
Constitution which empowered him to negate the lawmakers summon, stressing that
such constitutional provisions were very clear on the limits of the oversight
and investigative powers of the state House of Assembly.
The statement by the NDDC counsel which
was in response to the House letter to Prof. Perefomode dated August 24, this
year read in part. "We regret to inform the Honourable House of Assembly that we
(NDDC) find no constitutional or legal backing for its resolution inviting the
honourable commissioner representing Delta State on the governing board of NDDC
to answer to the summons, for the purpose of supplying the requested
information".
"For the avoidance of doubt, the
constitutional provisions of sections 103, 128 and 129 vis-a-vis the
implication of the exclusive and concurrent legislative lists, to say the least,
are very clear on the limits of the oversight and investigative power of the
state House of Assembly.
"While the commission remains committed to
forging cordial relationship with all institutions within the states in which
she operates in this circumstance, the honourable commissioner representing
Delta State has been advised to respectfully decline your (House) invitation,"
the letter added.
