APGA crisis: Okorie wants Ojukwu’s nomination quashed
Chekwas Okorie Thursday urged the Federal High Court to nullify the nomination of Dim Chukwuemeka Ojukwu as the party’s presidential flag-bearer.
Okorie who was back at the court on the orders of the Court of Appeal, also urged the court to nullify the list of all candidates submitted by the Chief Victor Umeh-led faction of the party "because Chief Umeh violated the order of the court that the status quo ante be maintained pending the final determination of the suit".
An agitated Okorie who gave evidence as leading prosecution witness in the case he filed challenging the legality of the recognition given to Chief Umeh’s faction of the party by the Independent National Electoral Commission (INEC) and its chairman, Professor Maurice Iwu "in utter disregard to the constitution of our party".
Chief Okorie further urged the court to commit to prison, Professor Iwu and other defendants in the matter who he insisted, disregarded the court order made last month asking that the parties took no further action till the case is disposed off.
In his testimonies, the APGA founder stressed that Chief Umeh "can only be recognized as the National Treasurer of the party, but was expelled at a time and later recalled after a reconciliatory meeting.
"It is my prayer therefore that this court makes an order that the leadership of APGA under me (Chief Okorie) has not changed.
"The court should also order that INEC has no power to recognize Chief Victor Umeh as the APGA National Charman and also to nullify all the actions he took which were hitherto recognized by INEC during the period filing of this action including the printing of new membership cards; opening of parallel headquarter and any other offices and also to nullify the list of candidates submitted by Chief Victor Umeh for the 2007 general elections.
"We also pray the court to commit all the defendants in this suit, including Chief Victor Umeh and Professor Maurice Iwu to prison for violating the order made by this court which as at today is that the status quo ante be maintained but which is grossly being disregarded by both INEC, Professor Iwu and Chief Umeh".
The hearing was full of drama and technicalities as Chief Chris Uche (SAN), leading counsel to Chief Okorie on one hand and Mr. Patrick Ikwueto (SAN) leading Chief Umeh’s defense team and Mr. Rasheed Yusuf, leading counsel for INEC on the other hand, exchanging tantrums and high velocity legal missiles.
At a point Mr. Yusuf denied the existence of a letter from INEC in which Chief Umeh was given recognition as national chairman of the party.
Chef Okorie had told the court that even though APGA constitution recognized him as founder of the party and as well given him the latitude to hold the office of national chairman for an unbroken renewable four-year period, "I was amazed when I received from the newspapers information that I had been removed by INEC and replaced by Chief Umeh".
Mr. Ikwueto who tried to debunk certain claims made by Chief Okorie concerning his status in the party, prayed for adjournment till today to enable him obtain a certified true copy (C-T-C) of a purported suit filed in the Abuja High Court by Chief Okorie, where he (Okorie) tendered the documents he needed.
Trial Justice Jonah Adah who warned that he would not be prepared to entertain unnecessary requests for adjournment or interlocutory pleadings, reluctantly granted Mr. Ikwueto’s request that the matter be adjourned.
